Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, checkout flows, sample collection kits, whole genome sequencing services, data files, reports, subscriptions, software features, AI-enabled features, support, and related services provided by Level Genomics LLC, a Wyoming limited liability company ("Level Genomics," "Level," "we," "us," or "our").

By accessing our website, placing an order, activating a kit, submitting a sample, uploading genetic data, creating an account, purchasing a subscription, or using any Level Genomics service, you agree to these Terms, our Privacy Policy, and, where applicable, our Informed Consent for Genomic Sequencing.

1. Services

Level Genomics provides direct-to-consumer, informational whole genome sequencing and genomic data services. Our services may include sample collection kits, whole genome sequencing at the sequencing depth selected in your order, bioinformatics processing, raw and processed data files, informational genomic reports, subscription-based data retention and reprocessing, AI-enabled research assistance, and the ability to upload existing genetic data from another provider.

Level Genomics services are currently available only in the United States. We may decline, cancel, or restrict orders, kit activation, sample processing, data upload, or account access where required by law, operational constraints, product availability, or our compliance policies.

2. Informational Use Only

Level Genomics services are for informational, educational, and personal research use only. They are not intended to diagnose, prevent, treat, cure, or monitor any disease or medical condition, and they are not a substitute for a physician, genetic counselor, pharmacist, or other qualified healthcare professional.

You should not make medical, medication, reproductive, insurance, employment, legal, or safety decisions based solely on Level Genomics results, reports, AI responses, or data files. If you have questions about health-related information, consult a qualified healthcare professional. If you are experiencing a medical emergency, call emergency services immediately.

3. Eligibility

You must be legally able to enter into these Terms to use our services for yourself. If you purchase or activate a kit for another person, you represent that you have authority to do so and that the person being tested, or their parent or legal guardian, will review and agree to the required terms and consent before testing begins.

Level may offer testing for minors or individuals under guardianship where a parent or legal guardian provides consent and completes any required verification. Availability for minors may be limited, delayed, or subject to additional requirements.

4. Accounts and Security

You may need an account to activate a kit, access results, download files, use subscriptions, or use AI-enabled features. You agree to provide accurate, complete, and current information, to keep your login credentials confidential, and to notify us promptly if you believe your account has been compromised.

You are responsible for activity that occurs through your account, except to the extent caused by Level Genomics' failure to use reasonable security measures.

5. Orders, Prices, and Payment

Prices, product availability, subscriptions, discounts, shipping options, taxes, and fees may change. The price shown at checkout applies to that order. You authorize us and our payment processors to charge the payment method you provide for your order, subscription, applicable taxes, shipping, and other disclosed charges.

We may refuse or cancel an order if payment is not authorized, the order appears fraudulent or unlawful, a product is unavailable, the shipping address is unsupported, or we determine that fulfilling the order would violate these Terms or applicable law.

6. Shipping, Kit Expiration, and Refunds

Unless otherwise stated at checkout, kit pricing includes standard outbound shipping and return shipping within supported United States locations. You are responsible for following the kit instructions and returning the sample within 60 days after purchase.

A kit expires if the return package is not scanned in by UPS within 60 days after purchase. After a kit expires, it will not be eligible for processing, replacement, or refund except where required by law.

You may request a refund of the kit purchase price, minus shipping costs and non-refundable charges, until the earlier of: (a) the date the return package is scanned in by UPS, or (b) 60 days after purchase. Once the return package is scanned in by UPS, the order is in processing and is not refundable except where required by law.

If a sample fails because of sample quality, collection, shipping, or laboratory processing, Level will provide one replacement kit at no additional charge. After one free replacement kit, additional replacement kits, reruns, or services may require a new purchase unless Level determines otherwise.

7. Sample Collection and Lab Processing

Depending on the kit provided, you may submit a saliva sample or buccal swab sample. You must collect, label, package, and ship the sample according to the instructions provided with the kit. Improper collection, insufficient sample quantity, damaged packaging, expired kits, missing information, or mismatched identifiers may delay processing or prevent results.

Samples are processed by a third-party laboratory that is CLIA-certified and CAP-accredited. The Level Genomics consumer service, reports, and AI-enabled features are offered for informational and Research Use Only purposes and are not clinical diagnostic services. We do not represent that Level Genomics services are FDA cleared, FDA approved, or intended for clinical diagnosis.

The laboratory receives samples identified primarily by kit or sample barcode. Customer identifying information is not included in the electronic sequencing requisition except as needed to provide the service, but the return shipment label may display the customer's return address because of carrier requirements.

Whole genome sequencing may be performed at 30x or 100x sequencing depth depending on the product ordered. Sequencing depth, coverage, and data quality are subject to biological sample quality, laboratory processing, sequencing technology, bioinformatics methods, and quality thresholds. We do not guarantee that every nucleotide, gene, region, variant type, condition, or category of result will be captured, analyzed, interpreted, or reported.

8. Results and Data Files

Level's customer-facing data deliverables are FASTQ, BAM, and VCF files. Your product or subscription may also include reports, interpretations, reprocessing, AI-enabled features, or other software features. Report availability and feature access may depend on your product tier, account status, subscription status, data quality, and current scientific knowledge.

Estimated result timelines are estimates only. Shipping delays, batching, sample quality, laboratory capacity, quality control review, bioinformatics processing, technical issues, and compliance review may affect turnaround time.

Genomic interpretation evolves over time. A result, classification, report, or AI response may change as scientific knowledge, databases, pipelines, or product features change. Level is not obligated to reanalyze, reinterpret, reprocess, or update your data unless included in your active product or subscription.

9. Level Insight Subscription

Level Insight is an annual subscription that may provide encrypted data retention, interactive reports, updated findings, reprocessing, and AI-enabled genomic research features. If you purchase Level Insight, your subscription automatically renews each year unless canceled before renewal.

Subscription payments are non-refundable after purchase or renewal except where required by law. If you cancel, you will retain access through the end of the paid subscription term. Cancellation stops future renewal charges but does not create a refund or credit for unused time.

If your Level Insight subscription ends and is not renewed, Level will delete your genomic data 30 days after the subscription term ends unless you request earlier deletion. You are responsible for downloading any files you want to keep before deletion.

10. Data Retention and Deletion

If you do not maintain a Level Insight subscription, your FASTQ, BAM, and VCF files will be available for 60 days after results are made available, then deleted from Level systems unless you purchase or activate a retention service before deletion.

If you maintain an active Level Insight subscription, Level retains your genomic data while your account and subscription remain active, subject to your deletion rights and our Privacy Policy.

If you request account or genomic data deletion, Level will delete active Level copies within 30 days and backup copies within 90 days, unless a longer period is required by law, fraud prevention, security, dispute resolution, or legitimate business record obligations. Physical samples and lab-side data may be retained by the laboratory for up to 60 days after reporting or upload, then discarded or deleted unless you provide separate express consent for longer retention or applicable law requires otherwise.

11. AI, Software, and Third-Party Providers

Level may use third-party laboratories, sequencing technology, cloud infrastructure, bioinformatics tools, AI providers, software vendors, payment processors, shipping providers, support tools, security services, and other service providers to deliver the services.

Sequencing, laboratory, and bioinformatics providers may process your sample and genomic data as needed to perform sequencing, quality control, file generation, and related services. AI, reporting, and software providers may receive limited genomic excerpts, derived data, prompts, context, or other information as part of providing a requested feature. Level will not provide AI or reporting providers with your full genome and will use reasonable efforts to provide only the information needed to reliably answer the question or deliver the requested feature.

Third-party services may be subject to their own terms, privacy policies, availability, security, and technical limitations. Level is not responsible for third-party services except to the extent required by applicable law or our agreements with those providers.

12. Uploaded Genetic Data

Level may allow users to upload genetic data generated by other providers. If you upload data, you represent that you have the right to provide that data to Level and to authorize Level to process it. Uploaded data may vary in format, quality, completeness, and compatibility. Level does not guarantee that uploaded data can be processed, interpreted, or used with every feature.

13. Prohibited Uses

You may not use Level Genomics services, results, reports, files, or AI-enabled features for any unlawful, harmful, deceptive, discriminatory, or unauthorized purpose. Without limiting the foregoing, you may not use our services for paternity, parentage, forensic, law enforcement, human identification, employment, insurance underwriting, eligibility, lending, housing, education, discrimination, or any criminal, judicial, or surveillance purpose.

You may not resell kits, submit a sample from another person without required consent, upload genetic data you are not authorized to use, interfere with our services, reverse engineer restricted software, attempt unauthorized access, scrape our systems, or use automated tools in a way that burdens or harms our services.

14. Intellectual Property

Level Genomics owns or licenses the website, software, reports, designs, workflows, text, graphics, trademarks, logos, code, pipelines, documentation, and other content we provide, except for your personal information, biological sample, and genetic data. Subject to these Terms, we grant you a limited, personal, non-transferable, non-exclusive right to use the services for your own lawful personal use.

You own your genetic data. You do not acquire ownership rights in Level software, analysis methods, databases, report templates, AI systems, commercial products, or research or service improvements developed by Level or its providers.

15. Service Changes and Termination

We may modify, suspend, discontinue, or replace services, features, subscriptions, reports, pipelines, file formats, pricing, and policies. We may suspend or terminate access if you violate these Terms, create risk for Level or others, fail to pay amounts owed, misuse the services, or if continued service would be unlawful or impractical.

Termination does not relieve you of payment obligations incurred before termination and does not limit our rights or remedies.

16. Disclaimers

To the fullest extent permitted by law, the services are provided "as is" and "as available." Level disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, completeness, clinical validity, clinical utility, and error-free operation.

Genomic data and interpretation have inherent limitations. Results may be incomplete, uncertain, incorrect, misclassified, not clinically validated, or not applicable to your personal circumstances. Negative, absent, or unreported findings do not mean that you have no genetic risk or health risk. Positive or reported findings do not mean that you have, will develop, or will avoid a disease or condition.

17. Limitation of Liability

To the fullest extent permitted by law, Level Genomics and its affiliates, officers, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including loss of data, loss of profits, loss of use, emotional distress, business interruption, or substitute services, even if advised of the possibility of those damages.

To the fullest extent permitted by law, Level's total liability for any claim arising out of or relating to the services or these Terms will not exceed the greater of (a) the amount you paid to Level for the service giving rise to the claim during the 12 months before the event giving rise to liability, or (b) $100.

18. Indemnity

You agree to defend, indemnify, and hold harmless Level Genomics and its affiliates, officers, employees, contractors, service providers, and licensors from any claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, misuse of the services, unauthorized sample submission or data upload, violation of another person's rights, or unlawful use of results or data.

19. Arbitration Agreement and Class Action Waiver

You and Level agree that any dispute, claim, or controversy arising out of or relating to these Terms, the services, any order, any subscription, any account, any sample, any data, or any communication between you and Level will be resolved by binding individual arbitration, except as stated below. This arbitration agreement is governed by the Federal Arbitration Act.

Before starting arbitration, the party seeking relief must send written notice describing the dispute and requested relief. Notices to Level must be sent to legal@levelgenomics.com and to Level Genomics LLC, Attn: Legal, 2261 Market Street, Suite 73187, San Francisco, CA 94114-1612, United States. The parties will attempt in good faith to resolve the dispute informally for 30 days after notice is received.

If the dispute is not resolved informally, it will be administered by the American Arbitration Association under its Consumer Arbitration Rules, except that any mass arbitration will be administered under the AAA Mass Arbitration Supplementary Rules and applicable mass arbitration fee schedule. If AAA is unavailable or declines to administer the dispute, the parties will use JAMS under its applicable consumer and mass arbitration procedures.

Arbitration will take place on an individual basis. You and Level waive any right to participate in a class action, class arbitration, collective action, representative action, private attorney general action, or consolidated proceeding, except to the extent such waiver is prohibited by applicable law. The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party's individual claim.

Either party may bring an individual claim in small claims court if the claim qualifies. Level may seek injunctive or equitable relief in court to protect intellectual property, confidential information, security, or service integrity.

You may opt out of this arbitration agreement by sending a written opt-out notice to legal@levelgenomics.com within 30 days after you first agree to these Terms. The opt-out notice must include your name, email address, mailing address, and a clear statement that you opt out of the arbitration agreement in the Level Genomics Terms of Service. Opting out of arbitration does not affect any other part of these Terms.

20. Governing Law and Forum

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules, except to the extent the Federal Arbitration Act governs the arbitration agreement or non-waivable consumer protection laws require otherwise.

For any dispute not subject to arbitration, the exclusive forum will be the state or federal courts located in Wyoming, unless applicable law requires a different forum. You and Level consent to personal jurisdiction and venue in those courts for such disputes.

21. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with a new "Last updated" date. Changes apply prospectively unless otherwise stated. If we make material changes, we may provide additional notice through the website, checkout, email, or your account.
